Appellant was convicted by a jury of possessing less than 28 grams of cocaine. After finding that appellant was a habitual offender, the jury assessed punishment at 35 years in the Texas Department of Corrections. This conviction was subsequently reversed and an acquittal ordered by a majority of the Beaumont Court of Appeals. Williams v. State, 770 S.W.2d 859 (Tx.App. - Beaumont 1989). We reverse the judgment of the Court of Appeals, and affirm appellants conviction.
